Terms of Service
Welcome to Limit Form Submissions. These Terms of Service (“Terms”) govern your use of the Limit Form Submissions software integration (the “Service”) provided by In Codse Studios. By installing the Service via the HubSpot App Marketplace, you agree to the following:
1. Description of Service
Limit Form Submissions is a third-party integration designed to provide enhanced functionality for HubSpot forms, specifically the ability to set submission caps. The Service requires a connection to your HubSpot portal via OAuth.
2. Subscription and Billing
Billing: Use of the Service is billed on a monthly or annual subscription basis.
Cancellations: You may cancel at any time. No refunds are provided for partial months of service.
3. Data Privacy
Permissions: You grant us permission to access specific data within your HubSpot portal (e.g., Form IDs and Submission Counts) necessary to perform the Service.
No PII Storage: We do not store the personal data of your form respondents; we only track the numerical count of submissions to trigger the “off switch.”
4. Limitations of Liability & Disclaimer of Warranties
“As-Is” Service: The Service is provided on an “as-is” and “as-available” basis. To the maximum extent permitted by law, In Code Studios disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
API & Third-Party Latency: You acknowledge that the Service relies on third-party APIs (HubSpot). Technical factors, including API rate limits, internet latency, or HubSpot service interruptions, may result in a margin of error regarding submission counts. In Code Studios is not responsible for any submissions that exceed the set limit due to these external factors.
Cap on Liability: In no event shall In Code Studios, its directors, or employees be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
Maximum Liability: Our total liability for any claim arising out of or relating to these Terms or the use of the Service shall not exceed the total amount paid by you to In Code Studios for the Service during the twelve (12) months prior to the event giving rise to the claim.
5. Indemnification
You agree to defend, indemnify, and hold harmless In Code Studios from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees) arising from:
Your use of and access to the Service.
Your violation of any term of these Terms.
Any claim that your use of the Service caused damage to a third party (e.g., a customer complaining about an overbooked event).
